These terms govern use of Tayari. Please read them carefully. By creating an account, or by making a booking through a page we host, you agree to them.
Definitions
- “Tayari”, “we” or “us” means Tayari, the provider of the booking and reservation software described in these terms.
- “Service” means the Tayari dashboard, the public booking pages we host for venues, the booking messages we send, and any related software we make available.
- “Venue” means a business that registers for an account to manage its bookings.
- “Guest” means a person who makes a booking with a Venue through the Service.
Who these terms apply to
These terms apply both to Venues and to Guests, but not in the same way. Most of what follows concerns Venues, because a Venue is the party with an account and a commercial relationship with us.
A booking is an agreement between the Guest and the Venue, not with Tayari. We provide the software that makes the booking; we do not operate the venue, deliver the service booked, or take responsibility for it.
Eligibility and accounts
To register a Venue account you must be at least 18 and authorised to act for the business you are registering. You are responsible for the accuracy of the information you give us.
You are responsible for keeping account credentials confidential and for everything done under your account. Accounts may be given either an owner or a staff role; owner accounts can change settings and configuration that staff accounts cannot. It is your responsibility to give each person the right role. Tell us promptly if you believe an account has been compromised.
The Service
The Service lets a Venue publish bookable lists, set availability, capacity, pricing, and services, take bookings from Guests, and send booking messages. We may add, change, or remove features over time.
We aim to keep the Service available and reliable, but we do not promise it will be uninterrupted or error-free. Maintenance, third-party outages, and faults happen.
Venue responsibilities
As a Venue, you are responsible for:
- The accuracy of everything you publish through the Service, including prices, availability, opening hours, capacity, and descriptions.
- Honouring the bookings you accept, and dealing fairly with Guests over changes, cancellations, and refunds.
- Your own lawful basis for collecting and using Guest information, and for any marketing you send. You decide what your booking form asks for and what you do with the answers.
- Making sure any marketing consent you rely on was genuinely given.
- Complying with the laws that apply to your business, including consumer protection, tax, and data protection.
You are the party responsible for Guest information collected through your booking page. We process it for you, as described in our Privacy Policy.
Acceptable use
You may not use the Service to:
- Break the law, or infringe anyone else’s rights.
- Send unsolicited marketing, or messages to people who have not agreed to receive them.
- Upload malicious code, or try to gain unauthorised access to the Service, to other accounts, or to the systems behind it.
- Interfere with the operation of the Service, including by placing unreasonable load on it or scraping it in bulk.
- Misrepresent your identity or your relationship with a business.
- Resell or make the Service available to a third party as your own, without our written agreement.
Bookings, payments, and refunds
Where a Venue takes payment at the time of booking, payment is taken through a third-party payment provider. Card details are handled entirely by that provider; we do not receive or store them.
Prices, deposits, refunds, no-show rules, and cancellation policies are set by the Venue, and any refund is a matter between the Guest and the Venue. Tayari is not a party to that transaction and does not issue refunds for a Venue’s bookings.
Fees payable by a Venue for use of the Service, if any, are as agreed with us separately. Where fees apply, they are exclusive of taxes unless stated otherwise, and you are responsible for any taxes arising on your own sales.
Messaging compliance
The Service sends booking messages over WhatsApp and email. These are transactional messages about a specific booking: confirmations, reminders, and notices of a change or cancellation.
If you are a Venue, you must not use the Service to send marketing to people who have not consented to receive it, and you must honour opt-out requests promptly. Messages sent over WhatsApp are additionally subject to Meta’s own policies for the WhatsApp Business Platform, and you must comply with them. We may suspend messaging for an account that puts our ability to send messages at risk.
Third-party services
The Service depends on third parties for hosting, data storage, message delivery, and payments. Their availability is outside our control, and interruptions to their services may interrupt ours. We are not responsible for third-party acts or omissions, and your use of a third-party service may be subject to that party’s own terms.
Intellectual property
The Service, including its software, design, and branding, belongs to Tayari and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable right to use it while your account is active and in line with these terms. Nothing here transfers ownership to you.
Content you upload — your business name, logo, images, descriptions, and similar — remains yours. You grant us the limited right to host, reproduce, and display it as needed to run the Service for you, including on your public booking page. You confirm you have the rights to the content you upload.
Feedback
If you send us suggestions or ideas about the Service, we may use them without restriction and without owing you anything for them. We are not obliged to keep feedback confidential.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will meet your requirements, that it will be uninterrupted or error-free, or that any message we attempt to send will be delivered. Message delivery depends on networks and providers outside our control.
Limitation of liability
To the fullest extent permitted by law, Tayari is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost bookings, lost data, or business interruption, arising out of or relating to the Service.
Our total liability arising out of or relating to the Service, across all claims in aggregate, is limited to the greater of the amount you paid us for the Service in the three months before the event giving rise to the claim, or the equivalent of fifty United States dollars.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.
Indemnification
If you are a Venue, you agree to indemnify and hold Tayari harmless against claims, losses, and reasonable costs arising from your use of the Service, your content, your dealings with Guests, your marketing, or your breach of these terms or of the law.
Suspension and termination
You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate an account that breaches these terms, that creates a legal or security risk, or where we are required to do so by law. Where it is reasonable and lawful to do so, we will give notice first.
On termination, your right to use the Service ends. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — survive termination.
Your data on termination
You can ask us for an export of your data while your account is active, and for a reasonable period after it closes. After that period we may delete it. Deletion may not be immediate, since copies can persist in routine backups for a time before being overwritten.
Changes to the Service or these terms
We may change the Service, and we may update these terms as the Service or the law changes. When we update them we will revise the “last updated” date above, and where a change is material we will take reasonable steps to tell Venues in advance. Continuing to use the Service after a change takes effect means you accept the updated terms.
Governing law
These terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Pakistan have exclusive jurisdiction over any dispute arising out of or relating to them or to the Service.
If any provision of these terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in force.
